Acceptance of Terms

“OJA Streaming,” “we,” “us,” and “our” mean OJA Streaming LLC, a New Mexico limited liability company. By accessing or using OJA Streaming, you agree to these Terms and Conditions. If you do not agree, do not use the service.

The Service

OJA Streaming provides high-fidelity background music radios and soundscapes for commercial use only, including retail stores, restaurants, hotels, and offices. The OJA catalog is directly controlled and licensed by OJA Streaming and is delivered exclusively through OJA Player with a PRO-Free Direct Public Performance License. Certain catalog recordings may incorporate AI-assisted production tools.

Third-Party Production Technology

OJA Streaming may use commercially licensed third-party production technology, including services provided by Suno, Inc.

OJA Streaming does not control or make representations concerning the training data, internal models, or underlying technology used by third-party technology providers.

OJA Streaming reserves all contractual and legal rights against any technology provider whose acts, omissions, representations, training practices, or systems give rise to a third-party claim involving an OJA catalog recording.

Nothing in these Terms releases or limits the responsibility of any third-party technology provider for its own acts, omissions, representations, training practices, or systems.

Trial Period

• No payment method is required and the trial does not renew automatically.
• At the end of the 7-day trial, your license automatically expires and access ends.
• To continue using the service, you must manually purchase a paid plan.

Paid Subscriptions

After the trial, you may purchase a monthly or annual package for 1, 3, 5, or 10 seats. The first seat uses the standard rate and each additional seat in the published packages receives a 30% discount. Plans above 10 seats require a custom quote.

• Monthly prices are $30, $70, $110, and $210 CAD for 1, 3, 5, and 10 seats respectively.
• Annual prices are $270, $640, $1,010, and $1,935 CAD for 1, 3, 5, and 10 seats respectively.
• Each seat authorizes either one concurrently active OJA Player Standard installation or one active audio zone within OJA Multi-Zone Player.
• The selected Player edition applies to the complete subscription. Standard and Multi-Zone seats cannot be mixed within the same subscription.
• OJA Player Standard permits one active Windows installation per seat across registered locations or independently managed spaces.
• OJA Multi-Zone Player uses one Windows computer for all seats in the subscription, assigns one seat to each active zone, and does not permit those seats to be activated on another computer.
• Multi-Zone operation requires compatible multichannel audio hardware and properly installed manufacturer drivers.
• Paid subscriptions renew automatically at the end of each monthly or yearly billing cycle until cancelled.
• You will be charged using the payment method provided at the time of purchase.

Cancellations and Expiry

• You may cancel your subscription at any time through your account.
• After cancellation, access continues until the end of the current billing cycle.
• Your license and access expire automatically at the end of the paid period if not renewed.
• There is no automatic renewal during the free trial.

Refunds

All purchases are subject to our Refund Policy. Due to the digital nature of the service, refunds are generally not provided except as required by law.

Payments

Prices and currency are shown before checkout. Payments are processed securely by Stripe using the payment methods available for the selected billing interval. All purchases are subject to our Refund Policy.

PRO-Free Guarantee & Commercial Use

• The license is valid only for the commercial locations you register.
• The PRO-Free guarantee applies only while the OJA catalog is played exclusively through OJA Player under an active license.
• You are responsible for any radio, television, Spotify, YouTube, personal streaming service, or other external content played at your business.
• Redistribution, public sharing, or resale of our audio is strictly prohibited.

Copyright Claims and Takedown

If a copyright owner reasonably believes that a specific recording in the OJA catalog is substantially similar to or infringes a protected work, the owner or an authorized representative may submit a documented claim to Support@OJAStreaming.com.

The claim must identify the protected work and the specific OJA recording, explain the basis of the claim, provide sufficient evidence of ownership or authority, and include accurate contact information.

OJA Streaming may temporarily suspend the identified recording while reviewing a sufficiently documented claim. Following review, OJA Streaming may restore, replace, or permanently remove the recording.

A claim concerning one recording does not affect the validity of licenses covering the remainder of the OJA catalog. OJA Streaming reserves all rights and remedies against technology providers or other parties whose conduct contributed to the claim.

Knowingly false or materially misleading claims may result in liability under applicable law.

Limitation of Liability

OJA Streaming is not liable for fines, legal actions, or damages resulting from music or other content not provided through OJA Player, use outside the scope of the registered license, an expired or inactive license, or any violation of these Terms.

Individual Arbitration and Class Action Waiver

Before commencing arbitration, either party must provide written notice of the dispute and allow the other party 30 days to attempt an informal resolution.

Any dispute arising from or relating to these Terms or the OJA Streaming service that is not resolved informally shall be resolved through binding individual arbitration under the Federal Arbitration Act. Arbitration shall be administered by the American Arbitration Association under its applicable Commercial Arbitration Rules and may be conducted remotely unless the parties agree otherwise.

Arbitration shall proceed only on an individual basis. Neither party may bring or participate in any class, collective, consolidated, coordinated, mass, or representative action or arbitration. The arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that party’s individual claim.

Each party knowingly waives the right to a trial by jury and the right to have a dispute decided by a court, except for eligible claims brought individually in small claims court and requests for temporary or injunctive relief involving intellectual property, unauthorized access, or misuse of the service.

This arbitration agreement and class action waiver survive cancellation or termination of the account. If the class action waiver is found unenforceable as to a particular claim, that claim must proceed in court and may not be arbitrated on a classwide basis.

Territorial Restrictions and Anti-Circumvention

OJA Streaming does not offer, sell, license, or provide the service to any customer located, resident, established, or operating in the United States or its territories, and the service may not be purchased for, provided to, accessed from, or used at any location within the United States or its territories.

You represent on each request for access, trial, purchase, activation, and use that all location and residency information you provide is complete and accurate. You must not use a virtual private network (VPN), proxy, relay, anonymization service, remote-access arrangement, hosted environment, falsified location information, or any similar method to conceal or misrepresent a prohibited location or to evade territorial controls.

Any attempted or actual circumvention is a material breach of these Terms and may constitute a material misrepresentation. To the extent permitted by applicable law, OJA Streaming may immediately reject the request; suspend or terminate the account, subscription, license, Player access, and seats without prior notice; cancel pending transactions; preserve relevant records; and treat playback occurring in a prohibited location as unauthorized and outside the scope of any OJA license. No refund or credit is owed for a suspension, termination, or revocation resulting from such a breach, except where applicable law requires otherwise.

The violating party is responsible, to the extent permitted by applicable law, for OJA Streaming’s actual damages and reasonable costs arising from the circumvention, including investigation, containment, enforcement, chargeback, third-party claim, arbitration, court, and reasonable attorneys’ fees and costs where recoverable. The violating party shall indemnify and hold harmless OJA Streaming LLC and its officers, employees, and agents from third-party claims, liabilities, losses, and reasonable expenses caused by the violating party’s prohibited-location use, concealment, or material misrepresentation.

OJA Streaming may seek temporary, preliminary, or permanent injunctive or other equitable relief to stop prohibited access or use. These remedies are cumulative and do not create a fixed fine, contractual penalty, or paid right to engage in prohibited conduct.

Governing Law

These Terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-laws principles. Any dispute not subject to arbitration under these Terms must be brought in the state or federal courts located in New Mexico, except where applicable law requires otherwise.
